[Manuscript - Unpublished], PROUDHON (Jean-Baptiste-Victor)
EXPLANATIONS ON THE CHAPTER ON ANTICHRESIS AND THE LAST THREE TITLES OF THE CIVIL CODE (art. 2085 to 2281)
Date :
    [circa 1830]
quarto, mottled fawn half-calf, gilt title on black background. Smooth spine decorated with small gilt friezes, very legible handwritten text (upper headcap very damaged, lower headcap and corners worn, boards slightly rubbed), very fresh interior, [46 handwritten leaves]-[43 blank leaves].
At the time this work was written, Proudhon was Dean of the Faculty of Law at Dijon (Côtes-d'Or). He was one of the first to undertake a scholarly study of the new Napoleonic Code. His work, which notably includes a Treatise on the Public Domain and a Treatise on the Right of Usufruct, had an immense influence in his time. It is still distinguished by its precision and the clarity of its style. This work most likely comes from the hand of a student who attended Proudhon's lectures. It is of exceptional interest because Proudhon, who had resolved to comment on the Civil Code in the order of its articles, did not have time to publish his commentary on the final section. This is therefore the only known record of this great jurist's work on antichresis (real estate pledges), mortgages, privileges, and prescription. Moreover, this manuscript is perfectly legible.
