In the first part, the author analyzes, "following a methodical classification, the meaning of the word 'third party' in the numerous texts of our positive legislation that use this term; a singularly arduous task, given a concept whose meaning changes depending on whether it is considered, for example, in Article 1165 of the Civil Code or in Article 1321, in Article 1328 or in Article 1397, in Article 941 or in Article 3 of the Law of March 23, 1855… At each step, the subject matter expands, and the problems multiply, in the examination of which the author's conscientiousness in documentary research and intellectual integrity are affirmed… More personal is the in-depth effort at synthesis to which the second part is devoted, which truly constitutes a contribution worthy of the attention of jurists. Faced with the impossibility of reducing the various aspects of the notion of third party to a single concept, Mr. Aussel has endeavored to reduce them to a few major definitions, showing that this irreducibility corresponds to the two trends affecting the general evolution of modern private law.
