    In this thesis, the author "actually revisits the entire problem of the coexistence of the roles of agent and custodian, as defined in Article 1384 of the Civil Code. Positive law clearly distinguishes between these two roles: an individual cannot be both independent, as custodian, and subordinate, because they are bound to obey their principal. Mr. de Lestang challenges this traditional position. In the first part of his thesis, Mr. de Lestang examines the normal situation: that in which custody belongs to the principal, where it automatically derives from this status. (...)
