“The Bulletin of the Society of Comparative Legislation (…) was unable to review the first edition of this work, published in 1943, at a time when the Bulletin's publication was suspended. This work was carried out under difficult conditions, as occupied France was cut off from many communications with other countries. As Dean de la Morandière very rightly states in his preface, this publication constituted at that time a commendable act of faith in the Law. It was necessary to revise it with much broader documentation, and taking into account the legislative changes that had occurred in fifteen years. This explains the renewed interest in this second edition, which is about a third larger than the first and which covers the legislation of 53 countries instead of 39; This work is all the more interesting because it was possible to secure the collaboration of 44 legal experts, representing the disciplines of various countries, and providing original documentation that the nine dedicated contributors to the first edition were unable to obtain. Following a laudatory preface by Dean de La Morandière, the book begins with a remarkable comparative synthesis essay written by Marc Ancel. Readers of the first edition had already appreciated the exceptional value of this work of comparative law. It is presented here in its original form, with the exception of revisions necessitated by the introduction of new legislation. Marc Ancel first lays out the legislative problem, examining successively the social role of adoption, the legislative policy pursued during the 19th and 20th centuries concerning it, and the legal characteristics of the institution. The author then presents a synthetic study of the substantive and procedural conditions of adoption, and subsequently of its effects. On this last point, he notes the tendency to diversify the institution and strengthen its effects. He concludes by examining the conditions, forms, and effects of revocation of adoption, where legislation permits such revocation. It is not possible, in this report, to highlight all the ideas that emerge from Mr. Marc Ancel's work. He himself noted some of them in the introduction he placed at the beginning of his study. There, he emphasizes how adoption is increasingly losing its original character as a legal fiction, becoming a real incorporation of the child into the adoptive family. One can add the tendency to make adoption ever easier, to the point that a number of legal systems even permit it in the presence of legitimate children. Similarly, Mr. Marc Ancel very rightly pointed out that, in adoption proceedings, there is a growing tendency to expand the jurisdiction of child protection agencies. It is not possible here to analyze the fifty-three reports concerning the details of the legislation in the various countries. Their authors should be congratulated for having been able to convey the essentials in a concise form, which allows the reader to quickly become informed.
