“What brings the jurist Carl Schmitt closer to Hegel is a radical rejection of legalism. Like Hegel, he rejects the abstract separation of law and politics, which often in fact masks the subordination of law to politics, even when the latter cloaks itself in the guise of morality. It is in similar terms that Schmitt and Hegel reject normativist, universalist, and moralistic abstractions.” The interest that Carl Schmitt’s thought attracts today stems primarily from his critique of the doctrine of the rule of law and the liberal representations that form its foundation. His alignment with National Socialism, a possible consequence of his theoretical reflection, necessitates a discussion of his arguments. For J.-F. Kervégan, the confrontation with Hegel’s philosophy reveals the limits of his decisionist postulate, according to which the normative order of law rests on a decision irreducible to all rationality. In turn, this confrontation sheds light on the profound meaning of Hegel's political philosophy and allows us to measure its relevance today (excerpt from the back cover).
