    Although the subject appeared to be widely debated at the time, the author, “concerned with establishing the conceptual unity of these institutions, abandons the common approach of prior and systematic examination of positive law [...]; he starts, in fact, from the postulate that, contrary to the generally shared opinion, the public establishment is a homogeneous notion, which can be defined a priori and abstractly, independently of its applications; and if there is a “crisis”, these would not concern the institution itself, but the abusive uses which are made of it” (J. de Gaudusson, in the International Review of Comparative Law, No. 4/1977, p. 860).
