    "Professor Piotet's excellent work reveals to the comparative lawyer that the surviving spouse's usufruct rights over the deceased spouse's estate have a very broad scope in Swiss law, as in French law, for the same reasons, and even more generously than in French law: in the presence of descendants, the surviving spouse can claim, intestate, the usufruct of half the estate (Art. 462 of the Swiss Civil Code) and, by testamentary disposition, can receive the usufruct of the entire share bequeathed to the common descendants (Art. 473). However, the implementation of these usufruct rights raises very complex technical problems, which, in France, are still incompletely studied." (…) Because it is a comprehensive overview of the issues raised by the surviving spouse's usufruct rights, and also because of the originality of the author's positions, Mr. Piotet's book is very insightful for the French reader. Many of the arguments offer useful references for further study of French law, particularly regarding the valuation of usufruct, community of enjoyment, and the effects of the usufructuary's status as an heir.
