    Mr. Gabriel Démante set out to provide some precise information on this subject and thereby arrive at more equitable assessments. The word mortmain has two meanings in our old law: it designates the status of communities and also that of the upper classes of the rural population. Naturally, Mr. Démante only mentions the mortmain of communities in order to dismiss it; his paper is entirely devoted to agricultural mortmain. The latter appears in two forms: real mortmain and personal mortmain. In the last century, mortmain was only an exceptional condition, known only in a small number of customary laws. Mr. Démante accurately describes its main features based on two of these laws: those of the Nivernais and the County of Burgundy. The author is led to study the famous trial of the chapter of Saint-Claude. Finally, he summarizes the reforms of Louis XVI and the Constituent Assembly in this matter. In the second part, the author presents his ideas on the origins of mortmain.
