    “The work comprises two parts. The first is entitled ‘Nature and Character of the Functions of the Constitutional Council in Relation to those of the Council of State Sitting in Contentious Matters (Organic and Substantive Characteristics)’ (pp. 51–156), and the second, ‘Convergence and Competition in the Exercise of the Judicial Functions of the Councils’ (pp. 157–294). It is undoubtedly the second part that is of greater interest, as the author has been able to analyze very pertinently the basic concepts used by the two high courts, in particular those of general principles of law, and those of ‘rules’ and ‘fundamental principles’ within the meaning of Article 34 of the Constitution.” He showed in particular that the decision of the Constitutional Council of November 27, 1959, had, in fact, determined the entire evolution of the two legal precedents concerning the notion of fundamental principles used by Article 34.
