    (Dramard no. 851). It is hardly necessary to introduce this text, which Chapus reminds us (DAG, vol. II, no. 382) contains "the most studied and most notorious of the early formulations of the distinction" [between public and private domain]. Proudhon is the founder of the thesis that the public domain is not the property of public entities, which hold only a right of custody over it. He is also the first author to acknowledge the possibility of a public domain belonging to local authorities, and especially to municipalities. This is the only French edition (a Belgian edition in two volumes appeared in 1835) of this major text, which, although written by a civil lawyer, is probably the best 19th-century source for the study of administrative property law. Recent administrative law textbooks still emphasize its importance in the controversy surrounding the nature of public domain property.
