(Berkeley BQV 192 V2 D344, missing from the BNF). The oath, “juramento,” is a religious act by which the swearer takes God as witness to their sincerity. The canonical adage states, “iuramentum est divini nominis attestatio” (the oath is attested by the divine name). There are several types: the assertory oath for the present and the past, the promissory oath for the future, oaths made to God, and oaths made for God. The law of oaths obviously raises considerable problems: is the oath-taking process itself lawful? What happens if one has, through ignorance, sworn to something false? And what happens when this false oath is made knowingly? There are also oaths that are prohibited (this is notably the case when one swears to disobey a superior authority), etc. This extensive treatise addresses all these questions in a very high-quality manner. A reference work.
