    This major treatise, in which the author clearly goes against the grain of the times, takes positions that are now being re-examined. See in particular the opening paragraphs: “Refutation of the prejudice that Pothier left nothing for modern scholars to do on sales and other contracts he addressed… Main points on which these doctrines are now outdated. His shortcomings and merits… Critical assessment of the preparatory work for the Civil Code and the spirit in which it should be used… Danger of court rulings and yet the usefulness of their study…” It should be noted that this treatise is the first written by Troplong following Toullier, presented here in its first edition.
