Regarding the author's presentation, see above. This text addresses one of the major controversies in 19th-century civil law: the possibility for parents to adopt their illegitimate children. The jurisprudence of the Court of Cassation was highly inconsistent until the ruling of April 1, 1846 (Sirey, 1846.I.273), and legal scholars themselves were deeply divided. Marcadé and Demolombe argued for nullity, while Duvergier, Aubry, and Rau argued for validity. In a lively style and employing a very interesting historical method, particularly to explore the Roman foundations of the issue, B also concludes that adoption was illegal.
