    A predecessor of Klüber, Schmalz published the German version of this text in 1817, a text whose influence on Savigny is striking. He particularly emphasizes the influence of the constitution of states in their historical development on that of international society. He then indicates in his program that he will study international law “not through treaties but through customs, for it is in them that the true law of nations lies.” Also noteworthy is the strong anti-French tone, the author being an advisor to the King of Prussia and a professor at the University of Berlin, at a time when anti-French sentiment was clearly evident there. This is rare.
