As René Savatier points out in the preface, “one of the main innovations of the law of March 11, 1957—perhaps the most important—was […] to enshrine contracts relating to this right of exploitation of the author within rules of public policy. This is what Mr. Huguet’s work reveals. And he emphasizes how the legislator’s desire, in enacting these rules of public policy, was to ensure, through them, better protection for the author in matters where there is no balance, in terms of business experience and economic power, between the muses and Mercury. But, as Mr. Huguet also shows, if the rules of public policy enshrined in the 1957 law, concerning contracts for the exploitation of literary or artistic works, were applied indiscriminately, they would risk, in reality, becoming, for authors, at least as much a danger as a protection.” Specifically, because they are less business-savvy than their contracting partners, they would see provisions designed to protect them turned against them, due to the latter's skill. Hence the research pursued by Mr. Huguet in his thesis. It consists of preventing a protective law from becoming an oppressive one. Rare and sought-after!
