To what extent did 19th-century river fishing law contribute to preserving fish stocks and the natural environment? By analyzing the regulations governing fishing following the French Revolution, this essay attempts to answer this question. The reader will discover that the "ecological continuity of waterways" was not a new concern. This example—among many others—demonstrates that public authorities were aware that the free movement of fish was essential for the upstream migration and development of certain species. It will also become clear that many regulations protecting wildlife owe much to scientists who, from the Second Empire onward, did not hesitate to challenge the government to legislate. Is environmental law, or can it become, a "field" of legal history? This is the other major contribution of this book, which puts this intriguing discipline to the test. While environmental law can be considered a new legal "field," it is clear that some of the problems it attempts to solve already existed more than two centuries ago. Seeking to understand these problems, and observing the responses that have been given to them, necessarily compels us to admit that so-called environmental law did not emerge from nowhere; hence the value of legal history in tracing its genealogy and examining its foundations.
