“After noting in the introduction the absence of a theory of international canals, the author traces in the first part the evolution of the Canal since the Firman of 1854, under the successive dominance of France, Great Britain, and Egypt. He emphasizes that the Khedive very quickly found himself unable to exercise his sovereignty, although in 1854-1856 he refused to relinquish his authority over a portion of his territory that fell under foreign influence. It was only in 1888 that the Convention of Constantinople established the status of the Canal, whose twists and turns the author recounts up to the present day. In the second part, Mr. Van der Mensbrugghe outlines the main guarantees intended to ensure freedom of navigation in the Canal: the attitude of the territorial power, the management of the Company, and the actions of international organizations. The measures taken by Egypt, particularly against Israel, are thus discussed at length; then the status of the Company. For the author, the nationalization of 1956 merely eliminated a de facto guarantee of freedom of navigation. The author has used extensive documentation, particularly regarding both domestic and international case law. The most important texts are reproduced in the appendix. A substantial bibliography concludes the work. The value of this study on "the guarantees of freedom of navigation in the Suez Canal" is therefore clear, a value further enhanced when it is placed, as the author does in the final chapter, within the broader context of structural changes in the international sphere.
