    “For several decades, the contractual actions of public entities have experienced remarkable growth. However, they encompass a wide range of realities. It is common for signed acts to contain certain elements characteristic of contracts but to create neither rights nor obligations. Therefore, traditional conceptual frameworks are insufficient to account for administrative practices. As the law currently stands, those classifying these acts have little choice. They must opt ​​for one of two accepted possibilities: either the act is a true contract, or it falls outside the realm of law. Consequently, there is now a gap between theoretical tools and administrative means. This leads us to define the contours of a new category of contractual acts, called administrative agreements, whose stipulations consist solely of directive statements. Developed through a substantive examination, this category can be conceived as a subset of a genus, that of contractual acts, the identification of which proceeds through formal analysis.” And it is possible to corroborate this distinction by highlighting their substitutive function.
