Bonnard's work leaves a rather unpleasant feeling upon reading: the bias towards an objective analysis of various legal theories in order to penetrate their internal logic constitutes a disastrous anticipation of the fate of legal positivism during the Second World War. However, one should note the fundamental pages on the refutation of racial inequality, written in terms highly symptomatic of the 1930s: “It can be demonstrated that this inequality (…) is an idea which, logically, cannot exist. It does not correspond to any objective reality. For races and their mixtures, one can conceive of differences, but not inequalities. The determination of the superiority of a race depends on certain values and a certain appreciation of these values formulated in a value judgment.” But since there is no single, objective criterion of values, each race will decide the question of superiority based on its own conception of values… When two races thus assert their superiority, there is no reason to deny this superiority to one and recognize it in the other. Their judgments are equally valid; only they are contradictory. Thus, the principle of racial inequality has no objective existence, because the alleged superiorities stem from purely subjective assessments which, consequently, are worthless since they cannot be considered valid in relation to one another and contradict each other.
