    A rare copy of the 1943 edition of this seminal treatise. The author maintains a certain distance from the evolution of criminal law under the Vichy regime, even though he had written a controversial work on the criminal law of the War and the National Revolution in 1942. In the preface to the first edition, published in 1939 and preserved in this edition, the author explained the meaning of his approach: “It is therefore at a time of transition and crisis that we are examining French criminal law in order to outline its structure. The repeal of our codes will be relegated to the past and will render partly unusable the jurisprudential movement that has been built upon their centuries-old foundations. The new law is being constructed in close relation to the parallel effort taking place abroad; the development of comparative criminal law is essential and is giving impetus to international criminal law.” It is interesting to compare this with the preface to the second edition: “The events that have unfolded rapidly over the past four years have prevented the new edition […] from being a simple reproduction of the previous one. In France, a distressing domestic and international situation, followed by war, then the change of regime and institutions, dictated the new direction of criminal policy. […] Our first edition announced the resolution of a conflict: that between the Neoclassical School and the Positivist School. Another conflict then arose, which the second edition sees concluded: that between repressive liberalism and authoritarianism. Authoritarianism triumphs: in some countries, as a result of a systematic will; in others, and especially in our own, because the force of circumstances imposed it. But the new criminal law that it grafted onto tradition, not without disturbing the harmony, is a law of crisis. In its current form, it cannot claim permanence.” This book, therefore, has the drawback of being published at a time of transition. At least it offers a picture – which we have strived to make objective and precise – of the repression at a particularly moving turning point in history. Rare.
